How to Get Your Security Deposit Back in India (Step-by-Step)
Updated 22 June 2026
Getting your full security deposit back in India is mostly about paperwork and timing — not luck. Most disputes are avoidable if you do a few things at the start and the end of your tenancy. Here's the step-by-step.
Before you move in: the step that saves your deposit
On the day you take possession, do a condition report: photos and video of every room, existing damage, fittings, and meter readings, all dated and shared with the landlord over WhatsApp or email. This single record is what protects you from being charged later for damage that was already there. Also get a signed inventory of fixtures and fittings.
Step 1 — Give proper written notice
Check your notice period and serve it in writing on time. Leaving without proper notice is the easiest reason for a landlord to make deductions.
Step 2 — Clear all dues and hand over clean
Pay rent, electricity, water, and society charges up to the last day, and keep the receipts. Hand the flat over in reasonable condition (normal wear and tear is fine — you're not expected to return it brand new).
Step 3 — Do a joint inspection and get deductions in writing
Walk through the flat with the landlord at handover. If they claim any deduction, ask for it itemised in writing with a reason. Compare it against your move-in condition report — you can dispute anything that was pre-existing or is just normal wear.
Step 4 — Request the refund in writing with a deadline
Send a written request stating the deposit amount, the agreed refund timeline from your agreement, your bank details, and a clear deadline. Keeping it in writing matters if you ever need to escalate.
Step 5 — If they delay or refuse, escalate
If the landlord stalls or withholds without justification, you have options — a formal legal notice, then the Rent Authority or consumer forum. We cover the full escalation ladder in what to do when a landlord won't return your deposit.
Catch deposit traps before you sign
The easiest deposit to get back is a fair one. Before signing, check the clause with FinePrint — it flags non-refundable portions, vague refund timelines, and discretionary deductions. See also security deposit rules in India.

- How long does a landlord have to return the security deposit in India?
- The deposit is refundable when you vacate, after lawful deductions. Most agreements specify a window — commonly 30 days. The Model Tenancy Act 2021 requires timely refund. Always check the exact timeline written in your agreement.
- What's the single best thing I can do to protect my deposit?
- A dated condition report with photos/video on the day you move in, shared with the landlord in writing. It's your proof of the flat's original state and stops disputes over 'damage' that was already there.
- Can a landlord deduct for painting?
- Only if your agreement clearly makes you liable for repainting. Routine repainting from normal living is usually the landlord's cost — a blanket repaint deduction is worth disputing.
